摘要
《劳动合同法》规定了用人单位解除劳动合同的严格条件,这对于制约和监督用人单位的解除行为,保护劳动者的工作权具有积极的意义。但是,由于立法规定的弹性化,给予用人单位很大的空间。在调研基础上,对用人单位单方解除劳动合同的法律制度存在的若干不足进行了初步分析,并结合实践的需要,提出了若干立法建议,使有关用人单位单方解除劳动合同的法律制度得以完善。
The Labor Contract Law sets a series of strict conditions for dissolving a labor contract by employing unit,which possess positive effect on the restraint of and supervision over the dissolving behavior of employing unit.However,the elastification of the legal provision gives employing unit very big space.Based on the investigate and survey,this paper analyzes some deficiencies existing in the legal system of unilaterally dissolving a labor contract by employing unit,and connecting with the actual requirements,puts forward some legislative proposals for the perfection of the legal system of unilaterally dissolving a labor contract by employing unit.
