论我国《村民委员会组织法》修改的前瞻性问题

Some Forward-looking Issues on the Revisal of the Organic Law of the Villagers’ Committees of the People’s Republic of China

修改《村民委员会组织法》,以完善基层民主,真正实现村民自治,已成为共识,只是在修改方案上存在分歧(小改、中改、大改)。从我国目前的立法现状来看,农村集体组织包括自治组织(村民委员会)和经济组织(农村集体经济组织),由于农村集体经济组织缺乏相应的组织法,实践中是否存在农村集体经济组织,以及其与村民自治组织关系等问题始终没有得到解决,已经对基层民主的实现和农村集体经济的发展产生障碍。因此,如何定性村民自治组织与集体经济组织的关系,成为修改《村民委员会组织法》面临的前瞻性问题。本文以两者应该合而为一为出发点,阐述修改《村民委员会组织法》相关具体问题。

It is universally acknowledged that the revisal of the Organic Law of the Villagers＇ Committees can help perfect the grass-root democracy and achieve the villagers＇ self-governing, but there are still some disagreements about the revisal plan. According to the current situation of Chinese legislation, the rural collective organization consists of self-governing organization （villagers＇ committee） and economical organization （rural collective economical organization）. Lacking of organic law in the rural collective economical organization, problems as to the existence rural collective economical organization and the unsolved problems on the relations between the rural collective economical organization and villagers＇ self-governing, have hindered the perfection of the grass-root democracy and the development of rural economy. Thus, how to characterize the relation between the villagers＇ self-governing organization and the collective economical organization has become the forward-looking issue of the revisal of the Organic Law of the Villagers＇ Committees. This essay discussed some relevant problems on it with the viewpoint that the two organizations should be combined together.
