摘要
使用人责任应采纳无过错责任原则,是一种替代责任或"为他人行为负责"之责任。使用人未能合理地选任、监督或培训被使用人,而就被使用人的侵权行为承担赔偿责任的,不属于替代责任的范畴,而是属于自己责任、过错责任。使用人能够证明自己在选任、教育和管理方面没有过失的,在向受害人承担赔偿责任后,可以向因故意或重大过失造成损害的被使用人追偿。
The liability of principal doing of his auxiliary which causes is a form of vicarious liability, which imposes the principals liable for the wrongdamage to another when carrying out their duties, whether or not negligence, breach of statutory duty or strict liability imposed on auxiliary. After compensating damage to the victim, the pal may recover from the auxiliary who intentionally or with gross negligence causes damage to another if the pal can prove that he was not negligent in the selection, training and management of the auxiliary.
