当代中国捐会习惯法与关系——以浙江省慈溪市附海镇蒋家丁自然村为对象的考察

The Customary Law and Structural Relations of the ROSCA in Contemporary China——An Inspection of Jiading Village

作为农村经济互助的重要形式,捐会在当代中国农村社会仍然广泛存在。本文以浙江省慈溪市附海镇庙西村蒋家丁自然村的捐会为考察对象,探讨了捐会的成立、内容、形式、履行、变更规范与关系的内在联系,分析了当代中国债权习惯法发挥功能的信任基础和社会背景、文化因素。

As an important mutual aid organization, Rotating Savings and Credit Associations （ROSCA） are popular now in the rural areas of contemporary China. With Jiading Village, Fuhai town, Cixi city, Zhejiang province as a sample, this paper observes the establishment, structure, form, conduct, and modification norm ROSCA and their interactive relations. Further, the faith basis, social background and cultural factors on and with which Chinese contemporary customary debt law exerts its function is also discussed.
