建构商标的合理使用制度

摘要合理使用是知识产权制度的重要内容。我国商标法律中对此只有原则性的规定。从合理使用制度有其存在的法理基础入手,分析了西方国家商标合理使用制度的规定,指出我国目前的商标法律在合理使用制度方面存在的缺陷,并对商标合理使用制度的建构提出自己的观点和建议。
