摘要
席卷全球的金融危机,使我国本来就很严峻的大学生就业形势雪上加霜。此种背景下,有必要梳理高职院校大学生以往的实习、就业形式,大学生就业中的法律问题。通常认为在校生实习期间与用人单位建立的不是劳动关系,在身份上也不认定为劳动者,不受劳动合同法保护。此观点值得商榷。我们应该从大学生切身利益出发,结合用人单位和学校的利益保护,在法律的框架下,就具体问题的解决进行探索。
The financial crisis adds to the seriousness of sluggish employment for the college graduates. Under this circumstance, the paper reviews the legal issues vocational college students have confronted in their previous practice and employment, for the purpose of legal establishment for the employment status of students and employers. The writers argue for a legal framework to combine the benefit of students, schools and employers.
