摘要
《物权法》第107条规定了对转让遗失物的处理。第107条能否视为第106条的例外规定从而排除善意取得制度在转让遗失物情形的适用,法律并未明示,在解释上亦存分歧,这给物权法的适用带来了困惑,且不利于财产的流转与交易安全的维护。
Article 107th in Property Right Law ofP. R. C. provides the settlement of the transfer of lost prop- erty. It is not expressed if the Article 107th is an exception to the Article 106th and if it can exclude the applica- tion of acquisition in good faith system in lost property transfer, and furthermore there are also disagreements on this point, which brings confusions to the application of Property Right Law of P. R. C. and negative factors to the property transfer and transaction safety.
