摘要
对抗制的诉讼、证据制度对应于分散性、对立性的鉴定管理制度;职权性的诉讼、证据制度对应集中性、中立性的鉴定管理制度。因为诉讼对抗制的改革趋势必然要求鉴定管理制度的适度分散化。但就管理体制的现况而言,分散化管理模式根本不可行,因此应结合国情,建立有限度的鉴定机构集中管理方式。这种管理方式认为需以行政管理为主、行业管理为辅的中国特色模式。
The evidence system of the adversarial litigation system corresponds to a dispersional and oppositional appraisal management system; the evidence system of the continental legal system corresponds to a concentrated and neutralized appraisal management system. The trend of the reform towards an adversarial litigation system requires decentralized appraisal to some extent. However, according to the current situation, decentralization is infeasible. China's appraisal management system should take a comparatively centralized way, with the administrative management as its center and industry management as supplement.
