摘要
针对航空运输关系中消费者一方面享受着电子客票带来的方便与快捷,另一方面自身的权益也不断地受到侵害,探讨了电子客票交易活动中的消费者可能面临受虚假信息侵害、电子合同不能得到适当履行、个人隐私及个人数据被泄露及不当利用等风险。认为:要切实保护消费者的权益,要求法律满足条件:买方和卖方都必须证明自己的真实身份、交易数据不可受到非授权方的更改、确保交易数据的机密性;这不仅是航空电子客票对法律的要求,也是所有电子商务对法律的要求。
While enjoying the convenience brought about by electronic tickets,consumers of air transportation services are constantly at risk of being harmed by false information,of electronic contract failing to be fulfilled,and of personal data being revealed or being used improperly.The author of this paper points out that consumer right can be well protected by fulfilling the following legal requirements:both parties in the transaction must prove the authenticity of their identities;information of the transaction cannot be changed by any unauthorized party and be kept in confidentiality.
