The American Civil War:an Interpretation from the Perspective of Constitution Making and Its Early Operation History

美国内战是由联邦宪法在宪法制定过程中对以下结构性、原则性问题上的妥协、回避与处理不当所致:联邦制度和最高主权归属的问题、共和制度与奴隶制度的关系问题。在存在这种内战祸根的前提下,宪法规定的刚性修正程序最终为它们在宪法初步运行阶段的宪政体制内彻底解决,设置了无法逾越的制度障碍与法律障碍,从而使得内战的爆发不可避免。

The American Civil War resulted from the compromise, avoidance, and improper dealing with the following structural and principal issues in the constitutional making process： the relation between the federal system and the ownership of the supreme sovereign and the relation between the republic regime and the slavery. Given the existence of these serious issues, the hard constitutional amendment procedure made them unresolved within the constitutional system and led unavoidably to the breakout of the Civil War.
