当前城市房屋拆迁中制度缺失及解决思路

目前,违法强制拆迁在全国各地蔓延开来,成为规模性、颠覆性破坏宪法和国家其他基本法律以及严重损害公民基本权利的一大社会公害,给人民群众造成了极大的痛苦。究其根源,以规范拆迁行为的龙头法规——2001年6月13日国务院颁布的《城市房屋拆迁管理条例》为主的拆迁制度存在着重大缺陷。为此,应从立法、行政、司法等方面。

At present, illegal and compulsive house-demolishlng is widely spreading in China, and become a public harm that widely and completely damages constitutional law and other country＇s basic laWs and seriously damages citizen＇s basic rights, which causes extreme pains to people. The reason is that the major statute which standardizes demolition behavior, Urban House-demolishing Management StatUte （June 13, 2001, issued by the State Cnuncil）, has fatal defects. So urban hnuse-demolishing system should be perfected through legislative, administrative,judiciary aspects, and etc.
