知识产权滥用防止机制研究

A Study of the Mechanism to Prevent the Intellectual Property Right Abuse

随着中国知识产权法学研究的逐步深入,禁止知识产权滥用成为学界日渐关注的话题。从单一的"权利保护研究"到"权利保护与禁止滥用并重",体现了理论探索不断完善的过程。本文从知识产权的价值出发,探讨知识产权滥用的含义、根源与表现,从而论述规制知识产权滥用的必要性;在借鉴相关国家规制知识产权滥用的立法及实践的基础上,就我国应如何防止知识产权滥用问题,从立法、执法等角度提出一些建议。

With the gradual deepening of the study of Intellectual Property Law, to prohibit the abuse of intellectual property right became increasingly concerned in the academic world. From the single study of ＂right protection＂to ＂both the right protection and the abuse prohibition＂, it reflects the process of continuous improvement of the theoretical exploration. This paper starts with the value of intellectual property right, explores the meaning, causes and performance of the intellectual property right abuse, and discusses the necessity to regulate the abuse of intellectual property right. On the basis of borrowing the related regulations and practice of the intellectual property legislation abuse, the paper puts forward some suggestions from he angles of legislation and law enforcement on how to prevent abuse of intellectual property right.
