论史境之中的公正概念

Historical Perspetive of Concepts of Justice

公正是什么,这个问题始终萦绕在人类思想的不尽追求中。对于公正概念的历史分析,以往多停留在阐释思想家的公正论说,或公正概念的类型变化,而忽视了公正概念本身的历史建构主义意义。本文否弃了那种"素材式"的公正史观,而阐述了一种"史纲式"的公正史境。通过历史建构主义方法的运用,可以发现公正概念的历史并不是思想素材在时间线上的简单铺叙,而是在概念范畴的革命变革的"前历史"和"历史"发展、交叠与转换的过程中实现的哲学表达。在严格的意义上,此种公正概念的历史分析是公正概念增长的基点。

What is justice？ This question has always lingered in the endless pursuit of human thoughts.For the historical analysis of the concepts of justice,most studies used to deal with the interpretation of justice ideas of thinkers and or the changes of the different types of conception of justice.The present puper discusses the concepts of justice not in a material type but expounds the concepts of justice in the guiding principle of history.By applying the method of history of constncctivism,we can find that the history of the concept of justice is not just the detailed description of materials of thoughts in terms of time,but it is the philosophical expression realized in the process of prehistorical and hostorical development of concept revolution and evolution,in the process of overlapping and transformation.Precisely speaking,the conception of justice in history constructivism is the real starting point for the analysis of justice.
