慈善组织信息公开的法理基础

Jurisprudence of Charity Information Disclosure

慈善组织信息公开是各国慈善法律所确立的基本制度。慈善组织信息公开的法理基础有两个方面:一是慈善组织是以公益为目的的、承担着重要公共服务职能和公共责任的组织;二是慈善组织信息公开制度的核心是公众知情权的保障。以慈善组织的公共性和公众的知情权为基础,建设我国的慈善组织信息公开制度,对我国慈善事业发展有着重要意义。

Charity information disclosure is a basic system established by most countries. Jurisprudence of charity information disclosure has two aspects： First, the charitable organization is based on the public interest and public responsibility; second, the key of the charity information disclosure system is protection of the public＇s right to know. Establishing of the charity information disclosure system based on the public nature of ctiaritable organizations and the public＇s fight to information is very important to charity enterprise in China.
