论公众对地方立法的全方位参与

All-directional Public Participation in Local Legislation

地方立法是我国立法体系的重要组成部分,公众参与地方立法反映出公民权利意识的觉醒和地方法制建设的热情,也是构建和谐社会的基础和表征。尽管我国的《立法法》等相关法律都不同程度的体现了扩大公民参与地方立法的思想,但实践操作过程中仍有许多现实问题亟待解决。如何在立法程序提案阶段和审议阶段建构公众参与地方立法的机制,以及完善起草阶段的参与制度,将是公民全方位参与地方立法的重中之重。

Local legislation is an imprtant component of our legislation system. It not only reflects the awaking of civic rights and enthuiasm of public participation in pursuing The Rule of Law, but aslo is the basis for building a harmonious society. Although the ＂Legislation Law＂ and other relevant laws reflect the ideas of public participation in local legislation,in practice the process still needs to solve many pratical problems. How to structure the mechanism of public participation in legislation during the proposal and construction stage, and how to improve public participation in the drafting stage will be the most imprtant things.
