城市管理综合执法的自由裁量权有其存在的客观需要,其表现形态多样。但在执法实践中自由裁量权时常被滥用,一定程度上直接破坏了执法的公正性,影响政府形象。因此,有必要在法律层面对其进行内外结合、刚柔相济的系统控制,使之沿着符合立法精神和宗旨的方向健康发展。
