辩诉交易与刑事和解制度的“断裂”与“弥合”

"Fracturing" and "Connecting":Relationship Between the Plea-Bargaining System and the Victim-Offender-Reconciliation

目前,中国学术界对辩诉交易与刑事和解这两种制度的研究存在某种"断裂"倾向。实际上,辩诉交易与刑事和解这两种制度原本就有密不可分的联系,二者在以下几个方面存在共性与契合:一是具有共通的理论基础,体现了相同的价值理念;二是都体现了对刑事诉讼中个体权益的关注,顺应了国际司法发展的潮流;三是辩诉交易是刑事和解的体现,刑事和解又是辩诉交易得以实现的前提保障。因此,应当从理论上实现两者的对接,从弥合与互补的角度,审视二者的辩证关系,并将它们作为构建中国辩诉交易制度的一项重要内容。

At present, there exists some kind of ＂fracture＂ tendency in the domestic academic circles in the research on the plea bargaining and the victim-offender-reconciliation（V-O-R） , In fact, these two systems originally inextricably linked to each other. They are in common in the following aspects： firstly, they have a common theoretical foundation, and reflect the same values; secondly, they both reflect the concern of the individual rights in criminal proceedings, and go with the tide of the development of international justice; lastly, the plea bargaining is a reflection of the V-O-R, and the V-O-R is a prerequisite protection for the realization of the plea bargaining. Therefore, we should connect the two systems, in theory examine the dialectical relationship between the two systems from the point of view of complementary, and regard them as an important element to build the Chinese plea bargaining system.
