国际法人本化趋势下的2008年《集束弹药公约》 被引量：6

摘要 2008年《集束弹药公约》的通过,是在集束弹药给平民带来的人道主义灾难持续引发关注的背景下,国际人道法领域新近取得的一个重大进展。《公约》对使用、生产、转移和贮存集束弹药加以明确禁止,并规定了清理集束弹药遗留爆炸物的国际合作机制和受害人保护机制等内容。该《公约》的达成,是现代国际法人本化趋势的一个有力体现,并表明国家基于军事必要性原则所拥有的行动自由正在越来越多地受到人道原则的制约,从而将对国际人道法的未来发展产生深刻影响。
