对转基因生物知识产权保护的思考

The Reflections on the Intellectual Property Protection of Genetically Modified Organisms

随着转基因生物技术的不断发展,转基因生物知识产权成为我国和世界范围内知识产权保护的重要内容。本文从权利主体、客体界限、国际贸易、国计民生、农民权利等方面分析了转基因生物知识产权存在的个性特征,并针对转基因生物知识产权面临的认知度低、资源共享平衡诉求和国际国内法规协调衔接等困境,提出了相应的对策建议。

With the continuous development of transgenic biotechnology, the intellectual property rights of genetically modified organisms become an important aspect of intellectual property protection in our country and around the world. In this paper, the characteristics of intellectual property rights of GMOs were analyzed in several ways including the rights of the main, the object boundaries ,international trade, the people＇s livelihood and farmers rights .In the end, the corresponding countermeasures were given to resolve the dilemmas including low awareness about intellectual property rights of GMOs, the demands of balance resources sharing and coordinating international and domestic laws and regulations.
