摘要
通过剖析医院、患者之间存在的法律关系,以及在这些法律关系中,医院、患者应享有的权利和应承担的义务,从中发现权利义务不平衡的法律缺陷,分析原因并提出初步解决建议。
The paper analyzed every behavior in medical diagnosis and treatment, analyzed legal -relationships existed be- tween hospital and patients, and rights and obligations of hospital and patients, investigated the unfair and legal faults. Finally, the paper analyzed the causes of the legal faults and made some suggestions.
