基于现代农业园区建设的农村土地承包经营权流转研究——以重庆市台湾农民创业园为例

A Study on the Transfer of the Farm Land Contract for the Managerial Right Based on the Construction of Modern Agricultural Park——Taking Taiwan Farmers Pioneer Park in Chongqing Municipality as an Example

现代农业园区建设与农地流转具有密切的关系:农地流转是加快现代农业园区建设和实现农业规模经营的前提条件,加强现代农业园区建设,有利于促进农村土地承包经营权合理流转。现代农业园区建设中农地流转存在的问题:一是现行法律法规对土地所有权主体规定得过于原则和笼统,存在所有者主体多元化和界定不清等问题;二是社会保障制度的滞后性严重影响了土地流转;三是土地流转中农村居民点的处理难度大,农民安置成本高;四是土地流转方式单一,土地收益分配不均。对策建议:一要加强地籍管理,明晰土地产权;二要加大社会保障制度建设的力度;三要妥善处理农地流转与农民安置的关系;四要采用多种农地流转模式,保障流转双方利益。

The paper points out the farm land transfer problems that emerged in the construction of modern agricultural park,these include:the mainstay of land ownership is too principles and ambiguous in the existing laws and regulations;the lagged social security system seriously affects the land transfer;it is difficult in handling rural residential areas,and the farmers settlements cost higher in the process of land transfer;the way of land transfer is single with unequal distribution of land revenue.To tackle these problems,some suggestions are offered:strengthening the cadastral management,clearly establishing land ownership;increasing the social security system construction;properly handling the relationship between agricultural land transfer and the farmers' settlement;ensuring the interests of the two sides by adopting various patterns for agricultural land transfer.
