第三人休克损害的非财产损害赔偿研究

摘要 第三人休克损害在比较法上成为了比较热门的课题,第三人休克损害及其救济是民事侵权行为法上争议颇多的一个领域,理论界和实务界对此均未达成一致。第三人休克损害有其独特的性质、特征及损害赔偿金的确定方式,其民事责任的承担方式主要以金钱赔偿为主。 Schockschaden dritter is the hot topic on the comparative law. Schockschaden dritter and its remedies are one of the ambiguous fields of torts and there are disputes in both legal theory and practice. Schockschaden dritter has its special nature, characters and the identify ways, and money compensation is the main way for civil liability.
