摘要
2008年施行的《劳动合同法》以对处于弱势地位的劳动者给予倾斜保护为立法宗旨,其中用大量条款对"劳动合同的解除"做了具体详细的规定,但尚有部分规定仍存在缺陷。本文针对这些缺陷进行了分析,并提出完善相应条款的建议。
The Labor Contract Law implemented in 2008 aims to give oblique protection to workers from the legislative angle. In the contract, a great many terms and conditions on the termination of the Labor Contract are specified in detail, but there are some provisions which are not clear, perfect and reasonable enough. This paper makes an analysis of these shortcomings and presents some corresponding suggestions on its improvement.
