摘要
民间习惯是乡土社会中自发形成的秩序规则,在我国社会转型时期,民间习惯与国家法在乡土社会中共同存在,是客观的事实。在农村法治秩序建设进程中,必须承认民间习惯存在的合理性,构建科学的机制促使民间习惯的司法化,保证司法行为在农村获得正当合理的基础。
Folk custom is an order and rule formed spontaneously in local community. In the transformation period of China society the coexistence of custom and state law is an objective fact. In the judicial construction in rural area we must accept the reasonable existence of folk customs, establish a scientific mechanism to adapt custom to judicial construction, and find a sound ground for judicial conduct in rural area.
