研究生学位论文开发利用中的著作权归属问题研究

Research on the Copyright Ownership Problems in the Exploitation and Utilization of Graduate Dissertations

研究生学位论文的著作权归属问题一直没有明确的立法规范,国内高校的规定也不尽相同,因此在开发利用中就存在诸多问题。通过对几所具有代表性的高校研究生学位论文授权材料的分析,总结了学位论文著作权归属的几种具体情况,并针对研究生学位论文开发利用中遇到的著作权归属问题提出了建议。

There has been no clear law to define the ownership of the copyright of the graduate dissertations. Domestic universities have no uniform rules either. Therefore, there are many problems in exploiting and utilizing graduate dissertations. By analyzing the authorized documents of the graduate dissertations in some typical universities, this paper summarizes some specific cases regarding the ownership of dissertation copyright. The paper also gives some suggestions on how to handle the copyright ownership problems in the exploitation and utilization of graduate dissertations.
