对未成年人犯罪的几点思考

随着我国现代化进程的快速发展,未成年人犯罪已经逐渐成为我国面临的严重的社会问题。对于未成年人的教育、改造和刑罚处罚也成为备受关注的热点课题。国际社会普遍认为对未成年人应以教育、引导、改造为主,尽量少执行刑罚处罚。我国法律对未成人犯罪坚持"打防并举,标本兼治,以防为主,法制教育"的原则,在未成年人犯罪适用刑罚方面坚持"从轻减轻处罚"和"不适用死刑"的原则。本文对未成年人跨年龄段犯罪的刑事责任及对未成年人不宜适用的刑罚进行探讨。

With the rapid development of our country＇s modernization, the delinquency has become a serious social problem of our country. The education, reformation and criminal punishment of the juvenile have become the hot topics of concern. It is generally held by the international community that education, guid- ance and reformation should be taken as the dominant factors to juvenile, and the application of criminal punishments should be minimized. China＇s law on delinquency follows the principles of ＂simultaneous cracking down and prevention, taking prevention as the dominant factor, legal education＂,＂ lighter punish- ment and mitigated punishment, and death penalty not being imposed＂.
