近海碳捕获和封存的法律问题研究 被引量：3

摘要 近海碳捕获和封存(CCS)在国际海洋环境保护公约中尚不具有完全的合法性地位。从推动技术发展的角度来看,《联合国海洋法公约》和《伦敦公约》应当确立近海CCS的合法地位。近海CCS具有破坏海洋环境的风险,需要对其进行有效的法律监管,为此可以借鉴《保护东北大西洋海洋环境公约》的近海CCS环境风险监管模式。为了有效防控近海CCS产生的环境风险,规制近海CCS运营行为,应当创设完善的近海CCS法制框架。
