摘要
请求返还鼠兔两兽首需要解决的焦点问题是:中国是否具有法律上的依据请求返还这两件流失海外多年的文物,以及能够用什么方式追回。以英美近年有关跨国文物所有权争议的重要判决为视角,作者提出中国如欲以诉讼方式请求返还流失海外的珍贵文物,其关键是采取合理的诉讼策略,主张适用对自己有利的法律,才能使流失海外的珍贵文物回归中国。
The return of the rat head and rabbit head is focused on the repatriation and in what ways. Based on the recent important Eng ownership disputes over cross border cultural property, the author ho if China has any legal claims for ish and American judgments for ds that there are great obstacles as well as opportunities for China to win the case if it initiates any legal proceedings. The key issue is to take a rational litigation strategy and claim to apply the law favor China＇s interests.
