对传闻证据规则的反思——基于对规则本身与引进论者的考察

Reconsideration on the Hearsay Rule——Based on the Inspection of Rule per se and its Introducer

传闻证据规则的产生背景、生存环境、理论基础和发展进程都与英美国家司法环境有着特定的联系,我国不完全具备这样的条件。引进论者在论证论据与对国情的认知、未来诉讼制度的预想方面都存在较大的错位。在笔者看来,修改完善相关性规则不但能起到引进传闻证据规则预想的作用,同时还能避免传闻证据规则本身存在的缺陷与引进该规则后没有土壤适合其生存的局面出现。

The background, existence, rationale and evolution of the Hearsay Rule are particularly connected with conditions in the English-speaking countries such as UK and USA. China has no such condition. Its introducers made significant mistakes on the way of proof, knowledge of Chinese situation and their expectations of the future proceeding system. Revising and improving the rule concerned, can make the imported rules regarding‘hearsay＇ effective, but also can avoid the flaws of the hearsay such and the phenomenon in which it dose not take root in suitable soil.
