论旅行社制贩分离分类管理制度的建设——兼评《旅行社条例》

A Study on the Establisment of Classification Management System of Travel Agency in China-A Comment on the Newly——Published Ordinance of Travel Agency

中国新颁布的《旅行社条例》取消旅行社分类制度,降低了旅行社经营国际旅游等业务的进入门槛,有利于旅行社扩大经营规模,但是不利于保护旅游者消费权益,也不利于形成旅行社垂直分工体系。通过介绍分析日本旅行社分类管理制度与分类管理的理由,说明了旅行社实施分类管理的必要性,建议建立中国的按职能分工来划分管理旅行社的制度。

A classified administration system of travel services was abolished by the newly-published The Ordinance of Travel Services. Law revision will favor Chinese tour companies to expand their business, but will also increase the risks of visitors not being compensated when their consumption rights are invaded. This paper compares the laws of travel services in Japan and China, and discusses the necessity of classified administration of travel services in China.
