摘要
哈特"法律规则说"的提出是继承了边沁、奥斯丁等人分析实证主义传统,坚持法律与道德两分的"分离命题"。他也受到奥斯汀和维特根斯坦语言哲学的影响,将日常语言哲学引入法学领域,并且吸收哲学中的解释学方法。至此为"法律规则说"的建构打下坚实的理论基础。鉴于该学说的哲学立场对于研究哈特法律思想以及挖掘学说的理论贡献和现实意义均具有不可或缺的基础性意义,因此主要探析其理论建构的哲学立场。
Hart proposed the famous ＂Legal Rule Theory＂, which is based upon Bentham and Austin＇s Analytical positivism. He adhered to the separability thesis. Influenced by J. L. Austin and Wittgenstein＇s philosophy of language , he introduced the philosophy of ordinary language into law and absorbed method of philosophy Hermeneutic. There are all the foundation of ＂Legal Rule Theory＂. In view of the importance of the philosophical standpoint to contribution and practical significance of ＂Legal Rule Theory＂, this article aims at analyzing philosophical standpoint of ＂Legal Rule Theory＂.
