法律解释的成本——兼论法律解释权的配置

传统意义上的法律解释被分为立法解释、司法解释和行政解释,几乎已经约定俗成。但从不同的标准出发法律解释分类的界限是模糊的。由于法律解释权享有主体的多元化,造成了法律解释局面的混乱。现行法律解释制度是一种奢侈的制度实践。高层机关抽象的法律解释在运用到司法过程中必须面对法官的具体解释,增加了重复解释的成本,法律解释混乱带来了协调冲突的成本,公众面对冲突法律解释要大幅增加守法的成本。现行法律解释不符合司法的现实需要,增加了法治的"交易成本"。必须统一法律解释的配置,降低法律解释的成本。
