遏制家庭暴力之法律对策探究

Research on Legal Countermeasures for Stopping Domestic Violence

预防和制止家庭暴力需要以新的思路加以多管齐下,综合治理。首先要进一步完善立法,制定一部专门的《家庭暴力防治法》,扩大家庭暴力及其保护对象的范围,明确家庭暴力的救助机构、救助方式、救助程序、制裁机构和法律责任等内容;其次要进一步明确公安、司法机关、政府各有关部门以及社会组织在预防和制止家庭暴力方面的职责,强化"司法介入"力度,建立系统的社会救助制度,以形成各方面联手合作,相互配合的有效机制。

Domestic violence needs to be prevented and stopped in a comprehensive way. First, we should perfect our legislation and make a special law on prevention and control of domestic violence, extend the scopes of domestic violence and of its protection scope, and clarify aid agencies, aid approaches, aid procedure, pun- ishing agencies and legal responsibility, etc. Next, we should further define the duties of the public security bu- reaus, of judicial departments, of relevant government departments concerned and of social organizations in pre- venting and stopping domestic violence so as to have an effective mechanism with parties＇ cooperation.
