农村集体土地所有权的程序建构及其限度——关于农村土地物权流转制度的前提性思考

Construction of the Procedure of Rural Collective Land Ownership and Its Limitation: Prerequisite Reflection on the Circulation System of Rural Land Rights

农村集体土地所有权在性质上属于私权,但我国现行农村集体土地所有权并不具有充分的自主性,在未来立法中应当赋予其完整的权能并为其建构具备可操作性的行使程序,在此基础上设计符合市场经济要求的农村土地物权流转制度。当前乡村社会环境与农民的法观念等因素的制约决定了农村土地物权流转制度只能采用渐式的变革模式。

Rural collective land ownership is a kind of private right. However, the current rural collective land ownership in our country is not fully autonomous. In the future legislation, rural collective land ownership should be enowed with complete powers and an effective exercising procedure, which is the basis for the design of an efficient circulation system of rural land rights. The reform of circulation system of rural land rights should advance step by step due to the restriction of the current rural social situation and farmers＇ legal consciousness.
