论探望权中未成年子女的权利保障

On the Right Guarantee of Minor Children in Visitation Right

在我国,妨碍以及放弃探望权行使的情况经常发生。探望权的强制执行,又会加深父母之间的矛盾,可能对单亲家庭的子女造成二次伤害。造成这种状况的原因在于以父母权利为中心的制度设计,忽视了未成年子女的个体利益。因此,应当以子女的权利保障为主线设计探望权法律制度,坚持未成人利益最大化优先的原则,支持探望权的实现,限制探望权的滥用,禁止探望权的放弃,合理划分权利与义务的界限,以权利制约权利,以最大限度地保护单亲家庭中的未成年人权利。

Hampering and abandoning the visiting right are often happen, while the enforcement of implementing deepens the contradiction between the parents, and hurt child again. The present visiting right mainly guarantee parent＇s interest ignoring child＇s interest. Therefore, the main task of visitation fight is to protect child＇s interest insisting the Child＇s Interests-First- Principle. Visitation right＇s implementing should be supported and abusing or abandoning of the right should be forbidden to make clear the line between fight and duty and protect the child＇s interests as much as possible.
