摘要
一般监督权是法律监督权不可或缺的重要组成部分,是检察机关得以成为法律监督机关的重要基础。由于历史的原因,目前我国检察机关并不享有一般监督权,这造成了法律监督权的残缺,使我国检察理论出现了难以克服的理论障碍。立法有必要恢复并重构检察机关的一般监督权。
General supervision power is the indispensible element of legal supervision power and the important foundation for procuratorial organ as the legal supervision organ. However, Chinese procuratorial organ does not enjoy the right to general supervise due to the historical reasons which causes the incompleteness of legal supervision power and hinders the establishment of procuratorial theory. Therefore, general supervision power of procuratorial organ is necessary for retrieval and reconstruction of legislation.
