摘要
贝卡里亚的刑法思想理论基础是建立在以"需要"为内容的人性观上的。而这种需要人性观的外在表现就是"趋利避害"。而贝卡里亚从这种需要人性观出发,论证了犯罪和刑罚,建立了贯穿《论犯罪与刑罚》的功利主义刑法思想。
Becaria＇s Criminal Law Thoughts are based on human nature of necessity ,whose outsider appearance is tendency of interest and avoidance of harms. From this Becaria discusses crimes and punishments so as to construct utilitarianism criminal thoughts which goes through the whole On Crimes and Punishments.
