摘要
量刑建议是近年来检察机关公诉部门尝试的一项意在加强审判监督的重要举措。本文通过探求大陆法系和英美法系实施量刑建议的法理根据分析这项制度的实践意义,并对于量刑建议制度实践的时间、主体等问题进行了比较分析,最终指出量刑建议制度的发展方向。
The authors of this paper have carried out a contrastive analysis of the advice system of the crime penalty measurement in legal systems in Chinese mainland and other countries such as England and America, and proposed the related developmental trend because in China the system is attempted to supervise the trial.
