摘要
运用社会性别分析方法和工具对特定历史时期的女工劳动立法进行了系统的分析和研究,认为在中国新民主主义革命时期的关于女工的劳动立法中表现出了时间上的持久性和连续性、立法的多层次性、保护权利的广泛性和全面性、劳动标准的逐步客观性等特点,当前的劳动立法应借鉴这一时期的有益经验,可将家庭私领域用工纳入劳动法范畴,关注女性工作权利与家庭义务的非冲突性,将可预见性的社会性别问题纳入立法之中,避免以男性为标准的立法视角。
Using gender analysis for female labor legislation in a particular ing analysis was made:The legislations on women labor in New Democratic and continuous process, shaped historical period to research, the follow- Revolution Period had been a long-term a multi-level law system, provided laborers a rather broad and complicated rights list and developed more practical and objective labor standards. It could be good references for our modem legisla- tions in following aspects: a) whether could domestic employment be governed by labor laws; b) whether could a non-inconsistent relation be found between the women~ work rights and their family obligations; c) how could any foreseeable gender problems be legislated and d) how to avoid new male oriented nature laws.
