对动物福利立法的思考

Thoughts on Legislation of Animal Welfare

动物福利是保护动物康乐的外部条件。立法层面,动物福利比动物权利更具有现实性和可行性。动物福利立法的宗旨不应当局限于保护动物自身,而应当上升到人与自然和谐相处的高度。动物福利立法的保护对象不应当局限于与人类有密切联系的具有感知能力的脊椎动物,而应当根据动物福利立法的宗旨加以确定。除了关注宠物动物、农场动物、实验动物、工作动物、表演动物和竞技动物的福利外,也应当关注野生动物的福利。野生动物的福利不仅仅限于免除或者减轻痛苦,更重要的在于保护野生动物的自然生态环境。

Animal welfare refers to the external conditions of animal well-being.On legislative level,with comparative to animal right,animal welfare is more realistic and feasible.The objective of legislation on animal welfare should not be limited to protecting animals themselves,but should be the realization of harmony between human and nature.Animal welfare law should not just protect the perceptive vertebrates that have close contact with human.The range of protected animals should be determined by the goal of animal welfare legislation.In addition to pet animals,farm animals,laboratory animals,working animals,performing animals and competing animals,wild animal welfare also should be protected.Wild animal welfare is not just the abatement or mitigation of pain,but protecting the natural habitat of wild animal is more important.
