Considerations to the Legislation on Modern High Technology

高科技立法已成为21世纪立法领域中最引人瞩目的现象。从内在要求来看,新世纪的高科技立法不能背离对人类的终极关怀这一理念,为此要协调好科技创新与可持续发展,市场调节与政府调控,高科技国际竞争与科技创新全球化三个方面的关系。从外在形式来看,今后高科技立法在内容、模式等方面,在很大程度上受现代高科技发展的影响。

The legislation on high-tech in 21st century will attract more and more attentions in the law field. From the view of its inner requisition, the high-tech legislation in 21st century should aim to en- sure the ultimate benefits of mankind, which decides that there are three issues to be dealt with in the process of high-tech legislation in the next century, which includes bringing science and technology in- novations and the sustainable development in line, assorting regulation of market with the control of governments and fitting the international competition in high-tech field to the wave of globalization. From the view of its outer form, the high-tech legislation in future will be influenced to some extend by the development of modern high technology.
