黑社会性质组织犯罪作为我国有组织犯罪的主要形式,其严重的社会危害性已成为社会治安的严重挑战,也成为构建和谐社会的重要障碍。黑社会性质组织的首要分子应该对黑社会组织所实施的犯罪承担主要责任;黑社会性质组织首要分子应对其他成员所做的概括性授权犯罪指示的一切后果承担责任;对于黑社会性质组织首要分子的犯罪意图和指挥作用等公诉机关难以证明的事实,可以适当地引入推定。

As the main form of organization crime, gangdom organization crime harms the peace and harmony of society greatly. The chief leaders in gangdom organizations should be charged with the crime carried out by the gangdom organization, including all the consequence caused by other members because of their general directions.
