死亡赔偿金与城乡差别——以我国人身损害赔偿制度检讨为视角

The Discrimination of Death Compensation between City and Countryside

死亡赔偿金是因为死者的生命权受到侵害的特有赔偿项目。死亡赔偿金具有财产损害赔偿与精神损害赔偿二重性。我国在死亡赔偿金方面的法学理论、立法与司法实践出现不同认识与误解,并因此导致在侵权损害赔偿中"同命不同价"的城乡差别现象。消除在死亡赔偿金方面的城乡差别,应当从理论源头建构符合损害赔偿目的性的体系。

Death compensation is a special compensation due to the infringement upon the right of the dead for life. Death compensation compensates both property damage and mental injury. In China, there are various views and misunderstandings in legal theory, legislation and judicial practice in the aspect of death compensation. That results the discrimination of compensation between city and rural area. To eliminate the discrimination of compensation between city and rural area, we should, from the theoretical foundation, establish a system which in accordance with the compensational purpose of the injurers.
