摘要
当前在我国司法实践中,司法鉴定启动程序中存在着侦查控诉机构的"自侦自鉴"、民事诉讼中的多头鉴定与反复鉴定等问题。这些问题的产生原因,主要在于当事人与司法机关在司法鉴定启动程序问题上的权利与义务设置不尽合理,一方当事人(或侦查控诉机关)享有独立的司法鉴定程序启动权,而另一方当事人却无法参与到司法鉴定启动程序当中。为了解决上述问题,可以将司法鉴定启动程序分解为司法鉴定程序启动决定权与司法鉴定机构(鉴定人)的挑选与确定权,并将这两种权利分别配置给两个不同的主体,就有助于减少双方当事人或当事人与侦查控诉机构在司法鉴定启动程序上的冲突,从而避免或减少前述问题的发生。
At present in China's judicial practice, there exist some problem such as Complaints Reconnaissance agency "Identification of their own reconnaissance" in Forensic startup programs, muhipoint identification and repeated identification in civil Litigation. Causes of these problems, mainly in rights and obligations of the parties and the judiciary unreasonable set in Forensic startup programs, a Party (or Complaints Reconnaissance agency) vested with independent judicial power to trigger the authentication process, while the other party is unable to participate in Forensic startup programs. In order to solve these problems, you can decompose forensic startup programs into the fight to decide of forensic proceedings and the right of the selection and determination of judicial appraisal organizations (experts) and these two rights were allocated to two different subjects, we can help on the reduction of the conflict among the parties, or parties to a Complaints Reconnaissance agency in Forensic startup programs, thus avoiding or reducing the above problems.
