Features of the New Casualty Investigation Code of IMO and its Impact Analysis

IMO新《事故调查规则》纳入SOLAS公约的强制实施,为各国开展海事调查提供了一个通用程序,加强了船旗国海事调查的责任与义务。本文分析了该规则的特点及其对我国海事调查制度的影响,提出了当前船东应对履约应开展的工作,旨在促进对该规则的理解。

The mandatory implementation of the Code of the International Standards and Recommended Practices for a Safety Investigation into a Marine Casualty or Marine Incident （Casualty Investigation Code） through a new SOLAS regulation provides a common approach to marine casualty and marine incident investiga- tions for all States. This Code further enhances the responsibility and obligation of flag states in marine casualty and marine incident investigations. This article analyzes the features of the Code as well as its impact on the investigation regime in China. At the end of this article, the writer suggests to ship owners the measures to be taken to comply with this new regulation. The objective of this article is to boost the understanding of this Code.
