由于意识形态的影响,对于矿权和矿业权的认识无论中外都有各自的偏差和歧见,文中试图透过矿业资源权属的演变和国际矿业权长期博弈形成的现行有效模式的分析,结合占有和所有权的真实历史逻辑,得出矿权和矿业权的本质属性,即矿权和矿业权都是对矿床的一种占有权,它们具有所有权的一切特征,是一种"准共同所有权"。

Because of the ideological influences, some deviation and dissensus exists in the understanding of mineral rights and mining rights at home and abroad. Based on the analysis on the evolution of mineral resources right and the effective model formed in the long term international gaming, the essential attributions of mineral right and mining right are revealed, namely they are both a kind of right of deposit possession and have all the characteristics of ownership and are a kind of ＂quasi-joint ownership＂, combining with the real historical logic of possession and ownership.
