The Research on WTO Informal Decision-Making Mechanism "Green Room"

决策机制是WTO法律体系的重要组成部分,随着成员越来越广泛,该决策机制面临着"不公平、不民主,缺乏效率"的批评意见。如何在效率与民主之间取得平衡,使决策结果有助于实现WTO的目标,已成为150多个WTO成员共同面对的挑战。绿屋机制是GATT历史时代的产物,是WTO成员在实践中摸索出的一种具有WTO特色的非正式决策途径。然而,绿屋引起的争议很大,合法性、代表性和透明度始终是检验绿屋的重要标准。

The word ＂Green Room＂ appears frequently in WTO throughout these years, and this is a controversial word. Some commentators accused ＂Green Room＂ of ＂dark room＂, allowing only a very few Members to participate in, whereas the majority of Members are excluded. This is a typical example for WTO decision-making mechanism as ＂undemocratic and not transparent＂, some people even call for eliminating Green Room meetings, while others wish to see Green Room Meeting continue. Based on a through survey of concept and characteristics of the Green Room Meeting, this Paper seeks to pinpoint some basic features of the informal decision-making mechanism of the WTO.
