外来务工人员社会保障权法律体系的构建

Establishment of Social Security Right Legal System of Migrant Workers

给予外来务工人员社会保障权关系到我国社会的可持续发展。但外来务工人员社会保障权在法律制定、框架设立、司法监督、实施效果等方面却不尽如人意,主要受到主客观因素的制约。完善外来务工人员社会保障权法律体系,需要从加快社会保障法律制度建设,制定相对独立的外来务工人员社会保障制度,建立外来务工人员社会救济法律制度等方面着手。

Granting migrant workers the social security right concerns the sustainable development of our society. However, the legislation, the frame establishment, the judicial supervision and the application of the right are not satisfied, and is mainly affected by subjective and objective factors. To improve the social security right legal system of migrant workers, measures should be taken to speed up the building of the legal system, to establish a relatively independent social security system and build up the social relief legal system of migrant workers.
