透视农地产权的模糊与“锁定”

通过分析失地农民权益遭受侵害的现状,指出农民产权模糊导致农民土地权益受损。产权主体模糊导致维权人身份不明,产权内涵模糊导致维权事项不清,产权处分模糊导致维权程序不畅。而这种产权模糊与"锁定"源于社会主义集体所有制的路径依赖,政府对模糊产权的默认和维护是阻碍集体土地产权制度实现制度创新的重要因素。只有政府重新界定产权,还权于民,破除政府对土地的垄断,三农问题的解决才有可能突破原有农地制度的"锁定",农民的土地权益才有可能得到真正的保障。

This paper analyzes the rights of landless farmers violated, pointing out that the farmers property rights ambiguity caused damage to the farmers land rights. Fuzzy property rights lead to the unidentified; unclear meaning results in ambiguous rights protection issues, ambiguous property rights disposition prevents protection. And this property vague and ＂ lock＂ results from the socialist collective ownership of the path dependence;the Government＇s default and maintenance of ambiguous property rights are impeding the innovation of the collective land property rights system. Only the Government re - defined property rights, break the government monopoly on land, three rural problems will be possible breakthrough in the existing system of agricultural land ＂lock＂ , and the farmers＇interest in land will be really protected.
