An Analysis of the Explicitness of the Judicial Explanations of the Criminal Law

现行刑法实施以来,最高司法机关制定了大量的司法解释。根据刑法性原则的基本要求,阐述我国刑法司法解释背离明确性原则要求的具体表现、刑法司法解释明确性的判断依据以及我国实现刑法司法解释明确性的相应对策。

Since the implementation of the criminal law, the highest judicial authorities formulate a lot of judicial explanations. According to the principle of criminal law, this thesis mainly discusses the concrete deviation of our criminal judicial interpretation from principles of explicitness, the reasons of judgment of the explicitness of criminal judicial explanations and the countermeasures to realize the explicitness of the judicial explanations of the criminal law.
